These Terms of Service (“Terms”) govern your access to and use of the GuestSpotter website, mobile application, and related online services (collectively, the “Platform”). The Platform is operated by GuestSpotter Inc., a Massachusetts corporation (“GuestSpotter,” “we,” “us,” or “our”).
By clicking “Accept,” creating an account, or otherwise accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy ( www.guestspotter.com/privacy-policy ) and Copyright (DMCA) Policy
( www.guestspotter.com/copyright-dmca-policy ) (collectively, the “Agreements”). If you do not agree, do not use the Platform.
1. The Platform
GuestSpotter provides an online and mobile service that connects professional tattoo artists (“Artists”) and licensed tattoo studios (“Studios”) for the purpose of scheduling tattoo appointments, consultations, and related services (collectively, the “Marketplace Services”).
GuestSpotter does not itself offer, supervise, or perform tattoo services. GuestSpotter is not a party to any agreement, transaction, or interaction between Users (defined below). GuestSpotter does not vet, endorse, or guarantee the licensing, qualifications, or practices of any Artist or Studio and assumes no responsibility for their acts or omissions.
2. Eligibility and Accounts
You must be at least eighteen (18) years old and legally competent to enter into these Terms. By using the Platform, you represent that you meet these requirements.
To access certain features, you may be required to create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
3. License to Use the Platform
Subject to these Terms, GuestSpotter grants you a limited, non-exclusive, revocable, non-transferable license to access and use the Platform for lawful purposes consistent with these Terms.
You may not (a) copy, modify, or create derivative works of the Platform; (b) reverse engineer or attempt to extract the source code; (c) use the Platform for any unlawful purpose; or (d) use automated means to access or collect data from the Platform.
This license is subject to compliance with applicable App Store or Google Play rules. GuestSpotter may suspend or terminate your license if you violate these Terms.

GuestSpotter may remove content or suspend accounts that violate these Terms.
5. Relationship Between Users
The Platform acts solely as an intermediary. GuestSpotter is not an agent, joint venturer, employer, or representative of any User.
All agreements, payments, and interactions between Artists and Studios are made solely between those parties. GuestSpotter is not responsible for communications, quality of services, cancellations, or disputes arising between Users.
6. Health, Safety, and Licensing Disclaimer
Tattooing carries inherent risks of infection, allergic reaction, or bodily injury. By using the Platform, you acknowledge and assume all such risks.
GuestSpotter makes no representations or warranties that Artists or Studios are properly licensed, trained, insured, or compliant with health or safety laws.
You are solely responsible for verifying the credentials, qualifications, and practices of any Artist or Studio before engaging their services.
7. Payments
GuestSpotter may facilitate payments between Users through integrated third-party payment processors (for example, Stripe, Inc.). GuestSpotter does not hold funds, act as an escrow agent, or guarantee payment.
All financial transactions are between the applicable Users and the payment processor. Users are responsible for all applicable taxes, refunds, and chargebacks.
GuestSpotter is not liable for payment errors, delays, or disputes.
8. User-Generated Content
Users may upload images, text, designs, or other materials (“User Content”). By posting User Content, you grant GuestSpotter a worldwide, royalty-free, non-exclusive, transferable license to host, display, and otherwise use such content for operating and promoting the Platform.
You represent that you own or have the right to upload the User Content and that it does not infringe any third-party rights.
GuestSpotter reserves the right to remove or disable access to any content that may violate these Terms or applicable law.

9. Intellectual Property
All content, software, and materials on the Platform, including the GuestSpotter name and logo, are owned by GuestSpotter or its licensors and are protected under intellectual property laws.
Except as expressly authorized, you may not copy, distribute, or create derivative works of any content from the Platform.
10. Disclaimers of Warranties
The Platform and all related content and services are provided “as is” and “as available.”
GuestSpotter expressly disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
GuestSpotter does not guarantee that:
(a) the Platform will be uninterrupted or error-free,
(b) user information is accurate or current, or
(c) any Artist or Studio will perform as represented.
11. Limitation of Liability
To the fullest extent permitted by law:
Some jurisdictions do not allow limitations of liability; in such jurisdictions, these limits apply only to the maximum extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless GuestSpotter, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of:
(a) your use of the Platform;
(b) your interactions or agreements with other Users;
(c) any bodily injury, property damage, or legal violation arising from tattoo services arranged through the Platform; or
(d) your breach of these Terms.
13. Termination
GuestSpotter may suspend or terminate your account or access to the Platform at any time, with or without notice, for conduct that violates these Terms or applicable law.
Provisions regarding intellectual property, disclaimers, limitations of liability, indemnification, and governing law shall survive any termination.
14. International Use
The Platform is controlled and operated from the United States and governed by U.S. law. GuestSpotter makes no representation that the Platform or its content are appropriate for use outside the U.S. Users who access the Platform from other jurisdictions do so at their own risk and are responsible for compliance with local laws.
15. Governing Law and Arbitration
These Terms are governed by the laws of the Commonwealth of Massachusetts , without regard to conflict-of-law principles.
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or any interactions between you and GuestSpotter shall be resolved exclusively by binding arbitration under the rules of the American Arbitration Association (“AAA”) then in effect. The arbitration shall take place in Boston, Massachusetts, in the English language, before a single arbitrator.
Each party shall bear its own attorneys’ fees, except as otherwise required by law. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You and GuestSpotter waive the right to a jury trial or to participate in any class action or representative proceeding.
16. Changes to These Terms
GuestSpotter may update or modify these Terms at any time by posting a revised version on the Platform. The “Last Updated” date above indicates the effective date of the latest version. Your continued use of the Platform after any change constitutes acceptance of the updated Terms.
