This Copyright (DMCA) Policy (“Policy”) applies to the website, mobile application, and related online services operated by GuestSpotter Inc., a Massachusetts corporation (“GuestSpotter,” “we,” “us,” or “our”) (collectively, the “Platform”).

GuestSpotter respects the intellectual property rights of others and expects all users (“Users”) of the Platform to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and other applicable laws, GuestSpotter will respond to valid notices of alleged copyright infringement and take appropriate actions, which may include removal or disabling of access to infringing material and termination of repeat infringers’ accounts.

1. Submitting a DMCA Notice of Alleged Infringement

If you believe that any content on the Platform infringes your copyright, you may submit a written notice (a “DMCA Notice”) to GuestSpotter’s designated Copyright Agent.

To be valid under the DMCA, your notice must include the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of such works.
  3. Identification of the material claimed to be infringing, or to be the subject of infringing activity, and information reasonably sufficient to permit GuestSpotter to locate the material (for example, a URL or screenshot).
  4. Your contact information, including name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

GuestSpotter may share copies of valid DMCA Notices with the User who posted the allegedly infringing material or with third parties as required by law.

2. Counter-Notification

If you believe that your content was removed or disabled in error, you may submit a written counter-notification to our Copyright Agent.

To be valid under the DMCA, your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., that you consent to jurisdiction in the U.S. District Court for the District of Massachusetts), and that you will accept service of process from the person who provided the original DMCA Notice or their agent.

Upon receipt of a valid Counter-Notification, GuestSpotter may restore the removed material in accordance with the DMCA unless the original complainant files a court action seeking to restrain the allegedly infringing activity.

3. Repeat Infringers

GuestSpotter will, in appropriate circumstances, terminate accounts of Users who are determined to be repeat infringers. The determination of whether a User is a repeat infringer is made at GuestSpotter’s sole discretion and may be based on the number and frequency of valid DMCA Notices received.

4. Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.

GuestSpotter reserves the right to seek recovery of such damages from any person who submits a materially false or fraudulent DMCA Notice or Counter-Notification.
