This Privacy Policy (“Policy”) describes how GuestSpotter Inc., a Massachusetts corporation (“GuestSpotter,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information obtained from individuals who access or use our website, mobile application, and related online services (collectively, the “Platform”).

By accessing or using the Platform, you acknowledge that you have read and understand this Policy and agree to its terms. This Policy is incorporated by reference into our Terms of Service

1. Notice at Collection

GuestSpotter may collect personal information directly from you, automatically from your device, or from third parties to operate, provide, and improve the Platform.

We collect and use personal information for the following purposes:

  • To create, manage, and verify user accounts.
  • To connect tattoo artists and studios and facilitate appointment scheduling.
  • To process payments through third-party payment providers.
  • To communicate with Users regarding their accounts, services, or Platform updates.
  • To operate, secure, and improve the Platform’s functionality.
  • To comply with legal and regulatory obligations.

2. Categories of Personal Information Collected

Depending on your interactions with the Platform, we may collect the following categories of information as defined by applicable U.S. state privacy laws:

  1. Identifiers: such as name, email address, phone number, account username, and password.
  2. Professional Information: such as tattoo artist license details, studio affiliation, certifications, and work samples.
  3. Images and Media: tattoo designs, portfolio images, or photos voluntarily uploaded to your profile or the Platform.
  4. Geolocation Data: approximate or precise location data if you permit location-based features.
  5. Payment Information: payment card data and billing address collected by our payment processor on our behalf.
  6. Device and Technical Data: IP address, browser type, operating system, app version, and usage analytics.
  7. Communications: messages or inquiries you send through the Platform.
  8. Inferences: derived preferences or interests based on your Platform activity.

GuestSpotter does not knowingly collect information from individuals under the age of 18.

3. Sources of Personal Information

We obtain personal information from the following sources:

  • Directly from you, when you create an account, complete your profile, make a booking, or communicate with us.
  • Automatically, through cookies, log files, analytics tools, and similar technologies.
  • Third parties, such as payment processors, authentication providers, and, where applicable, public license registries.

4. Use of Personal Information

GuestSpotter uses the information described above for the following business and operational purposes:

  • To provide, maintain, and personalize the Platform.
  • To facilitate scheduling, payments, and communications between Users.
  • To verify user identity and maintain Platform integrity.
  • To detect, prevent, and address fraud, security, or technical issues.
  • To enforce our Terms of Service ( www.guestspotter.com/terms-of-service ) and comply with legal obligations.
  • To communicate administrative or promotional updates.
  • For internal analytics, performance monitoring, and service improvement.

We do not use personal information for automated decision-making or profiling that produces legal or similarly significant effects.

5. Disclosure of Personal Information

GuestSpotter may disclose personal information to the following categories of recipients:

  • Service Providers and Contractors: including hosting, analytics, and payment processing vendors.
  • Business Partners: such as third-party integrations or marketing affiliates (only where permitted by law).
  • Legal and Regulatory Authorities: where disclosure is required to comply with legal obligations, court orders, or enforce our rights.
  • Successors or Assignees: in connection with a merger, acquisition, or sale of assets.

GuestSpotter does not sell or share personal information as those terms are defined under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).

GuestSpotter retains personal information only as long as necessary to fulfill the purposes described in this Policy, unless a longer period is required by law or necessary to protect our rights.

When determining retention periods, we consider factors such as the type of data, the purpose of collection, legal requirements, and the potential risk of harm from unauthorized disclosure.

7. Your Rights Under U.S. State Privacy Laws

Depending on your state of residence, you may have the following rights:

 

          • Right to Know: to request disclosure of the categories or specific pieces of personal information collected about you.

          • Right to Delete: to request deletion of personal information collected about you. Account deletion may also be initiated directly within the Application by accessing the Profile section via the bottom navigation, opening the Settings section from the top right corner, selecting the “Delete Account” option, and confirming the request through the confirmation prompt.

          • Right to Correct: to request correction of inaccurate personal information.

          • Right to Opt-Out: to opt out of the sale or sharing of personal information (GuestSpotter does not sell or share personal information).

          • Right to Non-Discrimination: to be free from discriminatory treatment for exercising your privacy rights.


To exercise any of these rights, please submit a request by email to info@guestspotter.com with the subject line “Privacy Request.” We will verify your identity before processing your request in accordance with applicable laws.

Authorized agents may submit requests on behalf of consumers where permitted by law, provided that proper authorization documentation is included.

8. Cookies and Tracking Technologies

GuestSpotter and its service providers use cookies, pixel tags, and similar tracking technologies to:

  • Enable Platform functionality.
  • Analyze usage and improve performance.
  • Support security and fraud prevention.

You may adjust browser or device settings to disable cookies; however, doing so may limit Platform functionality.

9. Data Security

GuestSpotter implements reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction.

While we strive to use commercially acceptable means to protect your information, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Cross-Border Data Transfers

GuestSpotter operates in the United States. Personal information collected through the Platform may be transferred to and processed in the United States or other countries that may not provide the same level of data protection as your home jurisdiction.

When required, GuestSpotter implements appropriate safeguards such as the EU-U.S. Data Privacy Framework or Standard Contractual Clauses to ensure lawful transfers of personal data.

11. Sensitive Information

Users may voluntarily upload content or information that could be considered sensitive, including images of tattoos, health-related disclosures, or professional licensing documents.

By submitting such information, you consent to GuestSpotter’s processing of that information for the limited purpose of providing and improving the Platform.

GuestSpotter does not use sensitive information for profiling or marketing.

12. Children’s Privacy

The Platform is not directed to individuals under eighteen (18) years of age. GuestSpotter does not knowingly collect or maintain personal information from minors. If we learn that we have collected such information, we will delete it promptly.

13. Third-Party Links and Services

The Platform may contain links to third-party websites, apps, or services. GuestSpotter is not responsible for the privacy practices or content of such third parties. Users should review the privacy policies of those sites before providing personal information.

14. Updates to This Policy

GuestSpotter may modify this Policy at any time. The “Last Updated” date above reflects the most recent version. Changes are effective when posted on the Platform.

Your continued use of the Platform after any update constitutes acceptance of the revised Policy.
